The question was a purely technical one, and the questioner probably knew quite well that the FCC representative couldn't answer it.  It was a perfect way to elicit a response that makes the FCC look bad.  Do you have any idea how large a bureaucracy the FCC is?  Do you think that broadcasting is the only business the FCC regulates?

There are plenty of legitimate criticisms of the FCC and the way it conducts itself.  This wasn't one of them.
