I don't think it's ever been tested in a court whether the mandatory
license for non-commercial broadcasters applies to non-wireless
broadcasting (assuming this provision isn't OBE by the DMCA).  Carl
Malamud tried, but he couldn't get the rights organizations to either
take his $1000 check or sue him for infringement.  (This was six or
seven years ago now.)
