RADIO FREE VERMONT and the FCC?

FCC Agents Narrowly Avoid Arrest By Vermont State Police
   On Tuesday, December 8th, at 12 noon, two agents from the Quincy
Massachusetts office of the FCC narrowly avoided arrest in the Town of
Rutland by an officer of the Vermont State Police.

   In defiance of legal and lawful Order to Cease and Desist served upon
the
FCC's office at Quincy, Massachusetts and Washington, D.C., and in
violation
of Title 18 of the United States Code, as well as in violation of their
jurisdiction per Title 47 United States Code,  agents from the Quincy,
Massachusetts office of the Federal Communications Commission, violated
Vermont Statutes Annotated Title 13 Section 3705 (Unlawful Trespass) and
the
United States Code Title 18 by trespassing upon private property outside of
their jurisdiction.

   Immediately upon spotting the FCC agents, Vermont State Police "C"
Barracks in Rutland Town were called and Trooper Hogan was immediately
dispatched to the scene to effect arrest for trespass. Approximately 2
minutes before Trooper Hogan's arrival,  the FCC agents vacated the scene,
narrowly avoiding arrest.

   If you should see the FCC agents in the area, you are urged to call the
Vermont State Police at 773-9101 or dial 911 immediately as they are wanted
for arrest and questioning. They were seen  in a vehicle resembling a Ford
Explorer-type utility vehicle with Massachusetts license plates ___- CN_
with a white rectangular rooftop attachment that appears to be about 3 feet
wide and about 6 feet long and about 5 inches high in the roofrack.

   If and when agents of the FCC appear again, they will be immediately
arrested by Vermont State Police. This is a serious matter and is being
treated as such. Charges can and will be filed and prosecution to the
fullest extent of the law will pursue.

U.S. Senate Judiciary Notified Of FCC Agents Trespassing
The U.S. Senate Judiciary Committee was notified immediately after the
above
incident, as they have been keeping a watchful eye on developments in this
case and are going to take action on this, as they understand that the FCC
is indeed attempting to overstep its jurisdiction.

Town Of Rutland Says "FCC Stay Off Our Property"

   Later in the afternoon of December 8th, Joe Zingale, Administrative
Assistant from the Town Of Rutland told Radio Free Vermont that the Town of
Rutland wishes to be notified if and when the FCC comes onto the property
of
the Town of Rutland, including Town roads and Rights of Way so that they
may
have them removed immediately due to lack of jurisdiction. Support for
Radiio Free Vermont is widespread in the community, including towns,
cities,
state and federal employees.

 Cease and Desist Order Now Recorded In The Town Of Rutland !

On December 9th, 1998, Radio Free Vermont received official notice that the
"Notice of: Failure To Respond To A Commercial Affidavit; Default; Order to
Cease and Desist", has been recorded in the records of the Town of Rutland,
having now been set in the law forever and legally binding upon all
parties.
