It's not a matter of "laywering they way out of" it. They haven't
done anything that violates the Communications Act, so it's none of
the FCC's business. Perhaps someone might have a state-law claim, if
there was a cognizable legal injury which is within CC's power to
remedy, but the Commission has enough to worry about enforcing its own
rules; it's not going to be policing every instance of broadcast
untruth. (It would have to devote an entire staff just to Limbaugh
alone if it wanted to, which it doesn't, and thankfully, it lacks any
authority to do so.)
