This would have to be a HAD situation.  Reason being, about 1995, I remember 
going to Potsdam NY to visit a friend of mine attending Clarkson University. 
  While there I was litening to Cool-FM 93.9 and what was then Energy 1200 
out of Ottawa CA.  I was absolutely shocked at how similar their programming 
was.  The both did an almost identical Top 5 at 5 Countdown, and many 
programming features between the two stations were almost identical as well. 
  Had this rule been in effect at this time that would've clearly been in 
violation of it.
