Dan Strassberg wrote about WAIT and the FCC.

I can't pull up the case on my computer -- it's not available on the Net --
but the case involving WAIT appears not to have gone to the Supreme Court.
It's cited in several later Supreme Court cases as WAIT Radio v. FCC, 418
F.2d 1153 (D.C. Circuit 1969).

I'll see if I can get a paper copy of the decision tomorrow and see what it
says.
