The license of a a station that is silent for more than one year (or, as Congress put it, "twelve consecutive months") expires automatically as a matter of law. This was in the Telecommunications Act of 1996 and I have not heard that Congress has changed its mind in the past 27 years. However, Congress did provide that "the Commission may extend or reinstate such station license if the holder of the station license prevails in an administrative or judicial appeal, the applicable law changes, or for any other reason to promote equity and fairness." 47 U.S.C. section 312(g). As a practical matter, the FCC rarely exercises this discretion. -GAWollman From joe@attorneyross.com Tue Mar 14 22:26:15 2023 From: joe@attorneyross.com (A Joseph Ross) Date: Tue, 14 Mar 2023 22:26:15 -0400 Subject: WSRO AM 650 HD In-Reply-To: <25617.9126.205916.421912@hergotha.csail.mit.edu> References: <1410523298.3185781.1678472114979@connect.xfinity.com> <0d05d028-b86b-05da-1836-22aad56c59e6@attorneyross.com> <25617.9126.205916.421912@hergotha.csail.mit.edu> Message-ID: <4ae1150a-56a9-1e96-5edb-215d75f4579d@attorneyross.com> I hope that whoever administers the estate knows about the deadline. Stations have done that from time to time. The FCC has been known to take a dim view of it, particularly in one case where a temporary antenna was mounted on a vehicle to put a signal on the air. I don't think a 24-hour return to the air would be accepted by the FCC today. He had a friend put it on the air temporarily on a longwire while he looked for a new site. He called me and asked me to find something to put on it in the meantime, so I borrowed 5,000 jazz cuts from WHRB and created a format using them on a computer I had in a closet. It ran for about a year before Alex built the Hyde Park site and put the Brazilians on 1410. Fast forward a few years, and the pandemic struck. Alex lost all his brokers and had me turn both 650 and 1410, along with 1240 on Cape Cod, off. Then a few months later he had me put 650 and 1410 back on, and I dragged the jazz computer out of my closet to feed both stations. 1240 on the Cape was sold to Bob Bittner, and 650 eventually went classical, but the jazz stayed on 1410 until the end. I copied the format to one of Alex's machines and took mine back home. So, if whoever's nowbin charge wants to go om the air, it could be done very easily.
