Radio World: LPFM Denied Due to Pirate History

So was there really any chance that the operator of Touch 106, Charles 
Clemons, would
have been able to have procured a legal LPFM license?

(I will never know how Allen Weiner was able to get a legal license for 
WXME-AM, WBCQ-FM and
WBCQ-SW after all his his well known history of breaking broadcast 
law/regulations.)
