FCC Broadcast buyback program..?

To me, what's interesting about the buyback program is that it appears to 
establish that broadcast licensees are the legal owners of the spectrum 
they use, notwithstanding the language to the contrary on their licenses.

Otherwise, why wouldn't the FCC just hold a hearing to determine whether 
the "public interest, convenience, and necessity" is better served by 
licensing a particular allocation to a TV channel or to a mobile broadband 
company?
