Sacramento is not enormously far away from Mountain View, and the
channel 6 there, KVIE, is an NCE.

They applied, and made claims about their programming.  The status was
created by Congress, and is open to any LPTV which (claims that it)
meets certain local programming requirements.  (Of course, the entire
LPTV service itself -- as distinguished from translators -- was
created by an earlier Congress.)
