Yes, it is illegal.  Section 705 of the Communications Act (47 USC §605; too long to quote here) says so.  Short version:  If a radio transmission is not intended to be received by the general public (i.e., not a "broadcast" within the Act's definition), then divulging its contents to a third party is illegal.
