Let's keep in mind, though you can argue on First Amendment grounds, the
Constitution does grant Congress the authority to legislate copyright laws.
Not only does the Supreme Court give a great deal of deference to Congress
regarding IP law, but of course Congress gives a great deal of deference to
the mega-media conglomerates with regards copyright law, especially in the
last decade or so, with things such as the DMCA, and the Mickey Mouse 95
year law, as you point out
