It may eventually end up in the courts.  There's been some talk
recently that current spectrum-allocation policies violate the First
Amendment, particularly since they don't even come close to meeting
``least restrictive means''.  Hopefully if it gets that far, Congress
will be given a chance to act before the entire RF spectrum gets
turned into a free-for-all.
