That's right. And they also must have an entertainment
license, which I think even applies to piping in music
or running TV sets. Right now, the Paradise nightclub
in Boston is in danger of losing their entertainment
license due to overcrowding, and the owners were quoted
as saying they'd have to close down if that happened.
In other words, you'd just have a bar with not only
no live bands, but also no piped-in music (since the
entertainment license would be yanked). The same
applies with regards to licensers like ASCAP or BMI.
Pay up, or no music will be allowed...and those who
defy this will get sued.
